1. Scope

These Terms and Conditions (AGB) apply to all orders placed through the online store shop.maktaba.ch, operated by Dargom AG, Büren an der Aare, Switzerland.

By placing an order, you agree to these Terms and Conditions. Deviating conditions from the customer will only be recognized if we expressly agree to them in writing.

2. Offer and Conclusion of Contract

  1. The presentation of products in the online store does not constitute a legally binding offer but rather an invitation to submit an order.
  2. By placing an order in the online store, you submit a binding offer to purchase the products in your shopping cart.
  3. The purchase contract is concluded when we accept your order by sending an order confirmation via email.

3. Prices and Payment Terms

  1. All prices in the Shopify store are quoted in Swiss Francs (CHF) and include statutory VAT unless otherwise stated.
  2. Shipping costs are displayed separately and shown during the ordering process.
  3. We accept the following payment methods, processed via the Shopify platform and Worldline:

    • PostFinance Card
    • PayPal
    • Shopify Payments
    • Prepayment (Bank Transfer)
  4. By selecting a payment method, you agree to the terms and privacy policies of the respective payment service providers.

4. Delivery and Shipping Terms

  1. Deliveries are made exclusively within Switzerland.
  2. The delivery time is generally 2–5 business days after receipt of payment, provided the products are available.
  3. If a product is unavailable, we will notify you immediately. Payments already made will be refunded in this case.
  4. We are not liable for delivery delays beyond our control.

5. Right of Withdrawal and Returns

  1. You have the right to withdraw your order within 14 days without providing a reason.
  2. Returns must be in unused, original packaging. Return costs are borne by the customer unless the goods are defective or incorrectly delivered.
  3. The right of withdrawal does not apply to:
    • Digital products (e.g., eBooks)
    • Specially procured or personalized items

6. Warranty and Liability

  1. Warranty is provided in accordance with legal regulations.
  2. We are not liable for damages caused by improper use of the products.
  3. Our liability is limited to gross negligence and intent, as far as legally permissible.

7. Data Protection

  1. Your personal data will be stored and processed as part of order processing and to enhance the shopping experience.
  2. Processing is carried out in accordance with Swiss data protection laws and the privacy policies of Shopify and Worldline.

8. Final Provisions

  1. Swiss law exclusively applies.
  2. The place of jurisdiction for all disputes is Büren an der Aare, Switzerland.
